European Commission proposal facilitates non-traditional marks

The European Commission has proposed changes to the regulations for trademarks to remove the requirement of ‘graphic representability’.  In view of non-traditional trademarks such as sounds, their report notes that representation by means of a sound file or other technological means, rather than graphical means, permits a more precise identification of the mark.  The increased flexibility is not intended to be boundless, and will be balanced by the goal of ensuring greater legal certainty.
